Consumer Right To Repair
Power Wheelchair
Rep. B Titone, Rep. D Ortiz,
Sen. R. Zenzinger
If you have a piece of equipment that needs repair, and you could repair it yourself if you had access to the parts, tools and owner’s manual, would you?
Or would you send it to a repair place and wait 4-6 months for it to get repaired?
Now what if that equipment provided you the means to be out of your bed, or home, and allowed you access to the world; would you repair it yourself or have an independent repair specialist fix your equipment?
This bill requires a manufacturer to provide parts, embedded software, firmware, tools, or documentation, such as diagnostic, maintenance, or repair manuals, diagrams, or similar information, to independent repair providers and owners of powered wheelchairs, to allow an independent repair provider or owner to conduct, maintenance, or repair services on the powered wheelchair.
A manufacturer's failure to comply with the requirement is a deceptive trade
practice, and nothing exempts the manufacturer from a products liability claim.
